Refunds & Returns Policy – PPD Performance Ltd
PPD Performance Ltd is a New Zealand–registered company and operates the website www.ppdperformance.nz. This Refunds & Returns Policy applies to purchases made via our New Zealand website.
Nothing in this policy is intended to limit or exclude any of your rights under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
1. Change of Mind / Incorrect Choice

As per New Zealand consumer law, we are not required to provide a refund or replacement if you change your mind or select the wrong product.

Where PPD Performance Ltd, at its discretion, agrees to accept a return for change of mind or incorrect choice, a 17.5% restocking and administrative fee will be applied and deducted from any refund.

Returned items must be unused, in resaleable condition and include all original packaging, accessories and documentation.

Exhaust systems and other products that have been installed on a vehicle and used are considered used and cannot be returned for change-of-mind or incorrect-choice reasons. Please ensure fitment is correct before operating the vehicle with the product installed.
2. Products with a Major Problem (Faulty / Not Fit for Purpose)
You may be entitled to a refund, replacement or repair where an item has a major problem, for example where:

The product is unsafe;
-
The product is significantly different from its description or sample;
-
The product is substantially unfit for its normal purpose and cannot easily be made fit within a reasonable time.
If an item has a major problem that prevents it from being used for its designed purpose, please contact us as soon as possible with:
-
Your order number;
-
A clear description of the issue; and
-
Photos or videos showing the problem, where possible.
We will assess the situation in line with your rights under New Zealand consumer law and may offer a refund, replacement or other appropriate remedy.
If the system or product has been correctly installed and used and is able to perform its designed purpose, it generally cannot be returned solely because you change your mind or decide it does not suit your preferences.
3. Products with a Minor Problem
If a problem is not major, PPD Performance Ltd will, within a reasonable time:

Repair the item, or
-
Where repair is not practical, offer a replacement or other appropriate remedy.
If the item cannot be repaired within a reasonable time, you may be entitled to a replacement or refund, in accordance with New Zealand consumer law.
The decision as to whether components are repaired, replaced or refunded will be made by PPD Performance Ltd, taking into account our legal obligations and the nature of the fault.
4. Items Damaged in Transit
If goods arrive damaged in transit, please notify us as soon as possible and no later than 14 days from receipt of the goods so we can assist with claims to the carrier.
When lodging a claim for transit damage, please provide:

Your order number;
-
A description of the damage; and
-
Clear photos of the damaged item and packaging.
Claims for transit damage made outside the 14-day window may be more difficult to process, as they may fall outside the timeframes set by carriers. This does not affect any rights you may have under New Zealand consumer law.
5. Special Order, Made-to-Order and Third-Party Items
We are unable to accept returns or order cancellations for third-party items that are:

Specifically ordered in for you;
-
Produced to order; or
-
Assembled to fulfil individual orders,
simply because you change your mind or no longer require the item.
Examples include, but are not limited to:

Ironman bull bars and accessories
-
Suspension components and lift kits
-
Black Duck® seat covers
-
EGR branded accessories (including flares, canopies, roller covers, soft covers, load shields)
-
Cruiser Console interior products
-
Emu Wing accessories
-
Direction Plus Diesel Accessories (including fuel filters and catch cans)
-
Electronic accessories
-
Meredith Metalworks snorkels, airboxes and components
Where PPD Performance Ltd, at its discretion, agrees to accept a return on such items:
-
Any refund will be reduced by:
-
Assembly and disassembly charges;
-
Any freight or return costs incurred in returning the item to the distributor; and
-
-
A restocking fee between 17.5% and 25% of the invoiced value will be applied.
6. Time Limits on Returns
Without exception, no returns will be accepted more than 90 days after the date of purchase, except where we are required to accept a return or provide a remedy under New Zealand consumer law.
If you believe a product is faulty, damaged or not as described, please contact us as soon as possible after becoming aware of the issue.
7. Incorrect Item or Pricing Errors
If an incorrect item has been sold and/or shipped, or an incorrect price has been charged due to an error:

PPD Performance Ltd reserves the right to correct the error, which may include cancelling the order, issuing a refund, or supplying the correct item at the correct price.

We will contact you to explain the situation and discuss the available options.
Any remedy will be provided in accordance with New Zealand consumer law.
8. Responsibility for Return Freight and Condition
The responsibility for the safe return of any item lies with you, the customer, unless otherwise agreed in writing or required by law.

PPD Performance Ltd is not responsible for items that are lost or damaged in return transit.

Refunds or exchanges will only be processed once items are received back in resaleable condition, except where the return relates to a fault or issue covered by New Zealand consumer law.

We recommend using a tracked and insured shipping method for all returns.
9. Order Cancellations Before Dispatch
If you wish to cancel an order before dispatch:

Please contact us as soon as possible.
-
Where cancellation is accepted, an administration processing fee of 7.5% of the order value will be applied and deducted from any refund.
For special order, made-to-order or third-party items (see Section 5), cancellations may not be possible once the order has been placed with the supplier.
10. Liability for Additional Costs
PPD Performance Ltd is not liable for any additional expenses incurred by you in order to remedy any defect in our products, except where required by New Zealand law. This includes, but is not limited to:

Labour or fitting charges;
-
Tuning, diagnostic or inspection costs;
-
Towing or vehicle transport;
-
Loss of use, travel costs or other consequential expenses.
Unless otherwise agreed in writing, PPD Performance Ltd will not cover removal, reinstallation or postage costs required to give effect to any warranty claim, except to the extent such costs must be covered under New Zealand consumer law.
11. How to Request a Return or Refund
No products are to be returned to PPD Performance Ltd without prior written consent.
