Terms and Conditions of Sale

PPD Performance Ltd is a company registered in New Zealand and operates the website www.ppdperformance.nz.
Our New Zealand Inland Revenue Department (IRD) number is 136-186-612.

These Terms and Conditions of Sale apply to all purchases made via www.ppdperformance.nz unless otherwise agreed in writing.

Nothing in these terms is intended to limit or exclude any rights you may have under New Zealand law, including (where applicable) the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.


1. Liability for Importation Costs

Prices listed on www.ppdperformance.nz are displayed in New Zealand dollars (NZD) and relate to the product supply and freight component only.

For deliveries to New Zealand addresses, any additional costs associated with importing goods into New Zealand – including, but not limited to, import duties, taxes, customs clearance fees and other government charges – are covered by PPD Performance Ltd. New Zealand customers will not be charged these costs separately by PPD Performance Ltd.

Most items are stocked in New Zealand. However, some items may be supplied by air freight from Australia. Where goods are imported into New Zealand from Australia, PPD Performance Ltd will manage and cover any applicable import charges for New Zealand customers.

For deliveries to countries other than New Zealand, any additional costs associated with importing goods into the destination country – including, but not limited to, import duties, taxes, customs clearance fees and other government charges – are the responsibility of you, the customer, and are not payable by PPD Performance Ltd.


2. PPD Performance Warranty Terms

PPD Performance Ltd warrants that all PPD Performance–branded products sold by us are free from defects in material and workmanship. Each product is warranted against defects in material or workmanship that cause the product to perform below reasonable expectations.

PPD Performance Ltd will, at its sole discretion, repair or replace any PPD Performance–branded product supplied by us that is found to be defective in materials or workmanship, provided that:

  • PPD Performance Ltd receives written notification of the alleged defect from you; and

  • The claim is made within 2 years from the original date of purchase.

Products sourced from third-party manufacturers or suppliers are covered by the warranty terms offered by those respective manufacturers or suppliers. We are happy to provide details of these warranties on request.

Nothing in this warranty is intended to limit or exclude any rights you may have under New Zealand consumer law.


3. Warranty Exclusions

PPD Performance Ltd is not a mechanical workshop and does not warrant, guarantee or accept responsibility for any installation work carried out by third-party mechanical businesses or individuals.

Please ensure you order the correct parts for your vehicle. Where PPD Performance Ltd is not at fault, the return of a product in unused, resaleable condition will attract a 17.5% restocking fee.

PPD Performance Ltd will not be held responsible for any delays in the supply of products, including delays caused by freight providers, manufacturers, customs inspections or other third parties.

The above warranty will not apply where:

  1. The product has not been correctly installed, or there is evidence of misuse, abuse, improper use, or negligence.

  2. The product has been modified, altered or repaired without prior written approval from PPD Performance Ltd.

  3. The product is used beyond the expectations or operating conditions specified by the original vehicle manufacturer.

  4. The product is no longer required, was incorrectly chosen by the customer, or the customer has simply changed their mind.

  5. The fault relates to damage or issues that existed on arrival and you fail to notify us within 14 days of receiving the product.


4. Return and Refund Process

Nothing in this section is intended to limit or exclude any rights you may have under New Zealand consumer law, including your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

  1. Change of mind / incorrect choice
    We are not required to provide a refund or replacement if you change your mind. Where PPD Performance Ltd, at its discretion, agrees to accept a return for change of mind or incorrect choice, a 17.5% restocking and administrative charge will be applied and deducted from any refund.

  2. Major problems / product not fit for purpose
    You may request a return or exchange where an item has a major fault that prevents it from being used for its designed purpose, in line with your rights under New Zealand consumer law.
    Once a product has been installed and used on the vehicle, and is capable of performing its designed purpose, it cannot be returned on the basis of fitment issues, so please ensure correct fitment before operating the vehicle with the product installed.

  3. Minor problems
    If a problem is not major, we will, within a reasonable time, repair the item. If the item cannot be repaired within a reasonable time, we may, at our discretion and in accordance with New Zealand consumer law, offer a replacement or refund. PPD Performance Ltd will determine whether components are to be repaired or replaced.

  4. Damage in transit or on arrival
    Any returns or claims for goods damaged in transit or during production must be lodged within 14 days of receipt of the goods. Claims made outside this period may not be accepted, as they may fall outside the terms and conditions of our carriers and suppliers.

  5. Third-party, made-to-order or specially sourced items
    We cannot accept returns or cancellations for third-party items that are specifically ordered in, produced to order, or assembled to fulfil individual orders, simply because you change your mind or no longer require the item.

    Where PPD Performance Ltd, at its discretion, agrees to accept a return on such items, any refund will be reduced by:

    • Assembly and disassembly costs;

    • Any freight or return costs incurred in returning the item to the distributor; and

    • A restocking fee between 17.5% and 25% of the invoiced value.

    These items include, but are not limited to:

    • Xrox / Outback Accessories & Ironman bull bars, rear bars, steps and accessories

    • Suspension components and lift kits

    • Black Duck® seat covers

    • EGR branded accessories (including flares, canopies, roller covers, soft covers, load shields)

    • Cruiser Console interior products

    • Emu Wing / The Cruiser Company accessories

    • Direction Plus Diesel Accessories (including fuel filters and catch cans)

    • Electronic accessories

    • Meredith Metalworks snorkels, airboxes and components

  6. Time limit on returns
    Without exception, no returns will be accepted more than 90 days after the date of purchase, except where required under New Zealand consumer law.

  7. Incorrect item or pricing
    If an incorrect item has been sold and/or shipped, or an incorrect price has been charged due to error, PPD Performance Ltd reserves the right to correct the error, including cancelling the order and providing an appropriate remedy (which may include a refund or replacement at our discretion and in line with New Zealand law).

  8. Responsibility for return freight
    The responsibility for the safe return of any item lies with you, the customer. PPD Performance Ltd accepts no responsibility for items lost or damaged in return transit. Refunds will only be processed once items are received back in resaleable condition, unless otherwise required by New Zealand consumer law.

  9. Quotes
    Quotes provided by PPD Performance Ltd are valid for 14 days from the date of issue. We reserve the right to revise and update a quote after this period to reflect any changes in pricing.

  10. Order cancellations before dispatch
    For orders cancelled prior to dispatch, an administration processing fee of 7.5% of the order value is applicable.

No products are to be returned to PPD Performance Ltd without prior written consent. All return requests must be directed to sales@ppdperformance.com.au (or the email address specified on our website). All return postage and associated costs are the responsibility of the purchaser, unless otherwise agreed in writing or required by New Zealand consumer law.


5. Liability for Additional Costs

PPD Performance Ltd is not liable for any labour, fitting, tuning, diagnostic, towing, vehicle hire, loss of use, or other associated costs you may incur in connection with the installation, removal, or replacement of our products, except to the extent such liability cannot be excluded under New Zealand law.

PPD Performance Ltd will not cover removal or postage costs required to give effect to any warranty claim, unless otherwise agreed in writing.


6. Product Indemnity

By purchasing and/or installing our products, you agree to indemnify and hold harmless PPD Performance Ltd from and against any loss, injury or damage to any person or property that extends beyond the warranties set out in these terms, including (without limitation) any incidental or consequential damages, except to the extent such liability cannot be excluded under applicable New Zealand law.


7. Legality of Modifications

Unless specifically stated otherwise, all parts supplied by PPD Performance Ltd are intended for off-road or motorsport use only.

Rules and regulations for on-road and off-road vehicles vary between jurisdictions. It is your responsibility to check and comply with all applicable laws and regulations in your area before modifying your vehicle.

Components designed to remove or alter diesel particulate filters (DPF), catalytic converters, or other emissions-control devices are intended for off-road use only in all known jurisdictions. Please consider this carefully before purchasing and installing such parts and ensure you understand the legal implications in New Zealand.


8. Product Shipping

While every effort is made to provide door-to-door delivery where that option is selected, this is not always possible. In particular, orders with any of the following attributes may need to be directed to your nearest freight depot for customer collection:

  • A residential delivery address is provided;

  • Delivery is requested to a remote or rural location;

  • Delivery is requested to a country or regional location;

  • The total weight of the order exceeds 30 kg.

To maximise the likelihood of door-to-door delivery, we recommend providing a commercial address for delivery of PPD Performance products.

Where items exceed 30 kg, door-to-door delivery is more likely to be available if you provide a commercial address with a forklift or suitable unloading facilities.

Transit times and delivery estimates are provided in good faith but are not guaranteed and may be affected by factors outside our control (including carrier delays, customs inspections and weather events).


9. Product Storage

Where orders are to be collected from PPD Performance Ltd, and collection does not occur within 30 days of us notifying you that the product is available for collection (and no prior written arrangement has been made), PPD Performance Ltd reserves the right to charge storage and handling fees as compensation for storage and administration costs.

If goods remain uncollected for an extended period, we may, after providing reasonable notice, return the goods to stock or dispose of them and may deduct any storage, handling or associated costs from any amount refunded (if applicable and in accordance with New Zealand law).


10. Governing Law

These Terms and Conditions of Sale, and any disputes arising in connection with them or with purchases made via www.ppdperformance.nz, are governed by the laws of New Zealand, and you agree to submit to the non-exclusive jurisdiction of the New Zealand courts.
